Part 333s – Smith Robertson Genealogy – Indenture Research – 1834 James and Archibald Smith - Carriacou

Morning,

The research and search continues. My Transcription Project of Indentures from the Grenada Registers of Records has now moved to Item 7 of the microfilm FHL [1563380]. The Smiths involved in this Indenture are James and Archibald who at present I do not have any documentary proof that either gentleman is, or was, a part of my ancestry and genealogy.

The Indenture is a contract that is between the Smiths and their partner Robert McCunn and one, Pierre Aman Belfon regarding the Hermitage Estate, I believe in Carriacou, and its matters and contents. There is no definitive or immediate hint or clue of any connection to ggg-grandfather James.

There may be some association with at least the Indentures I worked on in Part 264s and Part 265s.

Entered 14 March 1834
this Indenture made the twenty second day of April in the year of our
Lord one thousand eight hundred and thirty three Between James Smith
Archibald Smith and Robert McCunn all of the City of Glasgow Merchants
there trading under the firm of James and Archibald Smith and Company of the
one part and Pierre Aman Belfon of the Island of Carriacou within the
Government of the Island of Grenada of the other part Witnesseth that they
the said James Smith Archibald Smith and Robert McCunn for and in con
sideration of the sum of five shilling sterling money of Great Britain to them
in hand well and truly paid by the said Pierre Aman Belfon at or before the
sealing and delivery of these presents the receipt whereof is hereby acknowledged
Have and each and every of them Hath bargained and sold and by these presents
Do and each of them Doth bargain and sell unto the said Pierre Aman Bellfon

His executors administrators and aʃsigns All that plantation estate or
parcel of land situate lying and being in the said Island of Carriacou in
the Government of Grenada called or known by the name of Hermitage
estate and containing two hundred and thirty five acres of land more or less
bounded in the East by lands of the late Thomas Davidson called Harvey Vale
on the north by the Carenage and in the South and west by the sea for howsoever
otherwise called known situate lying or being bounded or distinguished and
the meʃsuage or dwelling houses kitchens stables houses outhouses stores tene
ments erections or buildings and fixtures thereon or thereto attached and all
ways waters watercourses paʃsages cisterns ditches woods underwoods trees or
chards fences hedges plantation implements and utensils easements emolu
ments profits and advantages whatsoever now being on the said plantation
estate or parcel of land and premises or to any part thereof in any wise belonging
or to or with the same or any part thereof usually held poʃseʃsed or enjoyed accepted
deemed or known as parcel or member thereof and all there fifty six negro slaves
thereto belonging whose names are set forth in the Schedule hereto annexed
marked A and all other the hereditaments and premises comprised in the said
Indentures of Lease and Release of the thirty first day of May and first day of
June in the year of our Lord one thousand eight hundred and twenty save and
except such of the said slaves as were granted and conveyed as aforesaid by the
several indentures of Lease and Release of the twelfth and thirteenth days of
March in the year of our Lord one thousand eight hundred and twenty two
and twenty eighth and twenty ninth days of August in the year of our Lord
one thousand eight hundred and twenty three and the Feoffment of the seventh
day of August in the year of our Lord one thousand eight hundred and twenty
two And also all those thirty four negro slaves whose names are set forth in the
Schedule hereto in annexed marked B the same being the negro slaves comprised
in the said Indentures of Lease and Release of the twenty fourth and twenty fifth
days of May in the year of our Lord one thousand eight hundred and twenty four
and the increase thereof together with the future iʃsue and increase of the females
thereof and the reversion and reversions remainder and remainders of all and sin
gular the said plantation estate or parcel of land meʃsuages hereditaments slaves and
premises and every part thereof and all the estate right title interest use trust
poʃseʃsion property claim and demand whatsoever at law and in equity of these the
said James Smith Archibald Smith and Robert McCunn and their heirs and aʃsigns
To have and To hold all and singular the said lands buildings slaves and premises
above mentioned to be bargained and sold with the appurtenances unto the said
Pierre Aman Belfon his executors administrators and aʃsigns from the day next before
the day of the date hereof for and during and until the full end and term of one
whole year and fully to be complete and ended Yielding and Paying therefor at
the expiration of the said term the rent of one pepper corn if the same shall be
lawfully demanded To the intent and purpose that by virtue of these and by
force of the statute for transferring uses into poʃseʃsion to the said Pierre
Aman Belfon may be in the actual poʃseʃsion of the said lands buildings slaves
and premises above bargained and sold and thereby be enabled to take and accept

Of a grant and release of the reversion and inheritance thereafter to him and his heirs
and aʃsigns in and by in denture or release intended to bear date the day next after
the day of the date of these presents and to be made between the said James Smith
Archibald Smith and Robert McCunn of the one part and the said Pierre Aman
