This next Document is recorded 2 April 1832 and entered to the Grenada Registers of Records 1 August 1832. And it is a long one. It involves land and property and the production of sugar specifically to, I believe two estates in the Parish of Saint Patrick; Union and Marli Estates. (See the inserted images from the Gavin Smith’s 1882 publication August, 1824 Reference To The Plan of The Island of Grenada.)
Shy of the immediate involvement of the Merchants James and Archibald Smith of Glasgow, there does not appear to be any connection or inter-action with ggg-grandfather James Smith.
There are 18 unique names that I have been able to transcribe included in this Record. This Indenture made the second day of April in the year of our Lord
one thousand eight hundred and thirty two Between George Paterson of the
parish of Saint Patrick in the Island of Grenada Esquire of the first part John
Ryburn and Andrew Ranken both of the City of Glasgow in that part of the
United Kingdom of Great Britain called Scotland Merchants of the second part and
James Smith Archibald Smith and Robert McCunn of the said City of Glas
gow Merchants and Copartners in trade of the third part Whereas by certain Indentures
of Lease and release bearing date the twenty third and twenty fourth days of March in
the year one thousand eight hundred and twenty four the release being made or expreʃsed
to be made between William Stuart and therein described and Helen his wife of the first part
Augustus Robert Hankey and William Alers Hankey therein respectively
described executors of Robert Hankey deceased who was the surviving executor of John
Hankey deceased of the second part the said John Ryburn and Andrew Ranken res

and other dead stock now upon or belonging to and used in the cultivation of the
said plantation or estate or any part thereof and all other the hereditaments
and appurtenances whatsoever to the said plantation or estate hereditaments
and premises thereby granted bargained and sold or intended so to be belonging
or in any wise appertaining or with the same or any part thereof used held oc
cupied or enjoyed or accepted reputed deemed taken or known as part parcel or
member thereof or of any part thereof and the reversion and reversions remainder
and remainders rents iʃsues and profits thereof with their and every of their appur
tenancies To hold the same with the appurtenances unto the said George Paterson
and his heirs to the use of the said John Ryburn and Andrew Rankin their execu
tors administrators and aʃsigns by way of Mortgage for and during the term of one
thousand years to commence and be computed from the day next before the day
of the now reciting Indenture of release subject to a proviso therein contained
for making the same term void upon payment by the said George Paterson his
heirs executors or administrators unto the said John Ryburn and Andrew Rankin
their executors administrators or aʃsigns or other the person or persons who should be
entitled to receive the same as therein mentioned of such sum or sums of money
at such times and in such manner as therein particularly mentioned and expreʃsed
and from and after the expiration or other sooner determination of the said term
of one thousand years and in the mean time subject thereto To the use of the
said George Paterson his heirs and aʃsigns And whereas there remained due and
owing from the said George Paterson to the said John Ryburn and Andrew Tank
in upon or by virtue of the said recited Indentures of Lease and Release of the
twenty third and twenty fourth days of March one thousand eight hundred
and twenty fou up to and on the thirty first day of March last past or balance
or sum of Sixteen thousand five hundred and fifty three pounds eight shillings
and eight pence of sterling money of Great Britain for principal and money and interest
And whereas the said George Paterson is seized in his _____ as of fee and
in a certain sugar plantation or estate called or known by the name of Union
Estate situate lying and being in the parish of Saint Patrick in the said Island of
Grenada free from incumbrances And whereas the said George Paterson stands?
indebted to the said James Smith Archibald Smith and Robert McCunn
in the just and full sum of one thousand eight hundred pounds of sterling money
of Great Britain And whereas the said John Ryburn and Andrew Ranken
having occasion for the said balance or sum of sixteen thousand five hundred and
fifty three pounds eight shillings and eight pence have requested the said George
Paterson to pay the same but it not being convenient for him so to do he hath applied

to do upon having as well the said sum of one thousand eight hundred pounds so due and
owing to them by the said George Paterson as aforesaid as also the said sum of Sixteen thou
sand five hundred and fifty three pounds eight shillings and eight pence so agreed to be
paid by them to the said John Ryburn and Andrew Ranken at the request of the said
George Paterson as aforesaid together with interest for the same sums respectively secured
by an aʃsignment of the said plantation or estate called Marli lands slaves hereditaments
and premises mentioned and comprised in and conveyed and released in and by the said
recited Indentures of Lease and Release of the twenty third and twenty fourth days of
March one thousand eight hundred and twenty four and the said residue of the said term
of one thousand years thereof and thereby granted or created and also upon having the
same sums respectively further secured by the covenant or agreement hereinafter contained
on the part and behalf of the said George Paterson his heirs executors and administrators
to ship the whole of the respective sugar crops of the said estate called Marli and of
the said Union Estate unto them the said James Smith Archibald Smith and Robert
McCunn and the produce and profits thereof by them applied in the manner hereinafter
mentioned Now this Indenture witnesseth that in consideration of the sum of
Sixteen thousand five hundred and fifty three pounds eight shillings and eight pence of
sterling money of Great Britain to the said John Ryburn and Andrew Ranken in hand
well and truly paid by the said James Smith Archibald Smith and Robert McCunn at
the request and by the direction of the said George Paterson testified by his being a party to
and executing these presents the receipt of which said sum of Sixteen thousand five hundred
and fifty three pounds eight shillings and eight pence and that the same is in full discharge
of all principal and interest money due and owing to them the said John Ryburn and
Andrew Ranken by the said George Paterson by virtue of or under the said recited Indentures
of Lease and Release of the twenty third and twenty fourth days of March one thousand

hereby acknowledge and from the same and every part thereof do acquit release and for

still houses edifices erections and buildings whatsoever erected standing and being
on the said plantation or estate or any part thereof and also all and singular
yards gardens pastures feedings commons trees woods underwoods hedges ditches
mounds fences ways path paʃsages wells waters water courses rivers gults ponds
pools easements priviledges profits commodities emoluments advantages hereditaments
rights members and appurtenances to the said plantation or estate and premises or

twenty four granted or created and which is or may be to come and unexpired freed and abso
lutely discharge of and from the said proviso for making the same term void contained
in the said recited Indenture of release but subject nevertheleʃs to the proviso or agreement
for that purpose hereinafter contained And the said John Ryburn and Andrew Ranken
do hereby for themselves their heirs executors administrators covenant promise and declare
with and to the said James Smith Archibald Smith and Robert McCunn their
executors administrators and aʃsigns that they the said John Ryburn and Andrew
Ranken have not nor hat either of them at any time heretofore made done executed
committed or knowingly omitted or suffered any act deed matter or thing whatsoever
whereby or by reason or means whereof the said plantation or estate slave lands meʃsuages
tenements hereditaments and premises hereby aʃsigned or mentioned or intended do to be
or any part or parcel thereof or any estate or interest therein respectively are or can shall
or may be in any wise impeached charged incumbered or prejudicially affected in estate
title value or otherwise howsoever Provided nevertheleʃs and it is hereby declared and
agreed to be the true intent and meaning of these presents and the said James Smith
Archibald Smith and Robert McCunn for themselves severally and respectively and
for their several and respective heirs executors and administrators fo hereby covenant promise
and agree with and to the said George Paterson his heirs and aʃsigns that if the said
George Paterson his heirs executors or administrators or any other person or person or his
or their behalf shall and do well and truly pay or cause to be paid unto the said James
Smith Archibald Smith and Robert McCunn for themselves severally and respectively and
for their several and respective heirs executors and administrators do hereby covenant promise
and agree with and to the said George Paterson his heirs and aʃsigns that if the said
George Paterson his heirs executors or administrators or any other person or persons or his
or their behalf shall and do well and truly pay or cause to be paid unto the said James
Smith Archibald Smith and Robert McCunn their executors administrators or aʃsigns
on or before the thirty first day of March next ensuring the sum of ten thousand five hun
dred pounds of sterling money of Great Britain that is to say the sum of one thousand
eight hundred pounds part thereof in payment and satisfaction of the said sum of one
thousand eight hundred pounds do due and owing by him the said George Paterson to the
said James Smith Archibald Smith and Robert McCunn as aforesaid and the
sum of Seven hundred pounds other or remaining part thereof in or towards payment or
reduction of the said sum of Sixteen thousand five hundred and fifty three pounds eight
shillings and eight pence so to the said John Ryburn and Andrew Ranken paid by
the said James Smith Archibald Smith and Robert McCunn at the request and by the
direction of the said George Paterson as aforesaid and do and shall on the thirty first day
of March in each and every year during the space of five years to be computed from and
after the said thirst first day of March and ensuing the date of these presents well and

Truly pay or cause to be paid unto the said James Smith Archibald
Smith and Robert McCunn their executors administrators or aʃsigns the clear
and full sum of Two thousand five hundred pounds of sterling money of Great
Britain in part payment and reduction of the said sum of Sixteen thousand
five hundred and fifty three pounds eight shillings and eight pence of like ster
ling the expiration of the said space of years to be completed as aforesaid well and
truly pay or cause to be paid unto the said James Smith Archibald Smith and Robert
McCunn their executors administrators or aʃsigns the remainder or balance which
shall be then due and owing of the said sum of Sixteen thousand five hundred and
fifty three pounds eight shillings and eight pence together with interest for the same
sums of money respectively or for such part thereof respectively as from time to time
shall be or remain due owing or payable after the rate of Five pounds for every one
hundred pounds by the year without any deduction or abatement whatsoever for or by
reason of any taxes charges aʃseʃsements cause matter or thing whatsoever and in case
the said James Smith Archibald Smith and Robert McCunn their executors or
administrators door shall at the request of the said George Paterson his heirs or aʃsigns
pay advance or lend any further or _____ sum or sums of unto or for the benefit
of the said George Paterson his heirs or aʃsigns and on account of the said Estates of
Union and Marli or either of them then id the said George Paterson his heirs executors

ced or lent to him by them with interest for the same at the rate aforesaid and
do and shall yearly and every year during the continuance of these presents truly
and faithfully ship send consign supply and deliver or cause to be shipped sent
consigned supplied and delivered (the dangers of the seas and the Kings enemies
only and always expected) at his or their own costs and expenses unto the said James
Smith Archibald Smith and Robert McCunn their executors administrators or
aʃsigns pursuant to the covenant in that behalf hereinafter contained all such
quantities and qualities of sugar as shall be annually made or manufactured during
the continuance of these presents as well on the said plantation or estate called
Union Estate belonging to the said George Paterson as upon the said plantation
or estate called Marli and hereby transferred and aʃsigned or mentioned or intend
ed so to be to the intent and purpose hereinafter in the said covenant in that
behalf mentioned and expreʃsed then and in such case the said James Smith
Archibald Smith and Robert McCunn their executors administrators and aʃsigns
shall and will from and immediately or at any time after such full payment and
satisfaction shall be so made as aforesaid upon the request and at the proper costs
and charges of the said George Paterson his heirs executors administrators or aʃsigns sur
render or otherwise aʃsure all and singular the said plantation or estate slaves lands
tenements hereditaments and premises hereby aʃsigned and transferred or mentioned

Or intended so to be with their appurtenances for all their estate right title and in
terest therein and thereto under and by virtue of these presents unto the said George Paterson
his heirs or aʃsigns or otherwise as he or they shall direct or appoint and the said George Paterson
for himself his heirs executors and administrators and for each other of them doth hereby covenant
promise declare and agree with and to the said James Smith Archibald Smith and
Robert McCunn their executors administrators and aʃsigns in the manner following that
is to say that he the said George Paterson his heirs executors or administrators shall and will

according to the true intent and meaning of the said proviso and of these presents And
further that he the said George Paterson his heirs or aʃsigns shall and will yearly and
further that he the said George Paterson his heirs or aʃsigns shall and will yearly and
every year during the continuance of these presents truly and faithfully ship send consign
supply and deliver or cause to be shipped sent consigned supplied and delivers (the
dangers of the seas and the Kings enemies only and always expected) at his or their own

their executors administrators or aʃsigns at the Port of Grenada or Port of Glasgow or

ship or ships or other veʃsels as they shall in that behalf furnish and direct between the first
day of March and the first day of August in each and every year all such quantities and
qualities of sugar as shall be annually during the continuance of these presents made and
manufactured as well on the said plantation or estate call Union Estate belonging to
him the said George Paterson as upon the said plantation or estate called Marli and hereby
transferred and aʃsigned or mentioned or intended so to be in order and to the end and intent
that by and out of the net profits and proceeds to arise from the sale of the same sugars
respectively the said James Smith Archibald Smith and Robert McCunn their ex
exutors administrators or aʃsigns may deduct and retain to themselves in the first place
the sum of Two thousand five hundred pounds sterling money of Great Britain that
is to say the sum of one thousand eight hundred pounds part thereof in payment and
satisfaction of the said sum of one thousand eight hundred pounds so due and owing by him
the said George Paterson to the said James Smith Archibald Smith and Robert McCunn
as aforesaid and the sum of Seven hundred pounds of like sterling money other or remaining
part thereof in or towards payment or reduction of the said sum of Sixteen thousand five
hundred and fifty three pounds eight shillings and eight pence so to the said John Ryburn

McCunn their executors administrators or aʃsigns may deduct and retain unto them
selves the clear and full sum of Two thousand five hundred pounds of like sterling
money in part payment and reduction of the said sum of Sixteen thousand five

the expiration of the said term of five years and during the continuance of these
presents deduct and retain to themselves the remainder or balance which shall
be then due and owing of the said sum of Sixteen thousand five hundred and fifty
three pounds eight shillings and eight pence together with interest for the said
sums of money respectively or for such part thereof respectively as from time to time
shall be or remainder due xxxx owing or payable at the rate of five pounds for every
one hundred pounds by the year and such further sum or sums of money so to be
paid advanced or lent as aforesaid with interest And the said James Smith Ar
chibald Smith and Robert McCunn for themselves their heirs executors and admin
istrators do hereby covenant promise declare and agree with and to the said George
Paterson his heirs and aʃsigns that they the said James Smith Archibald Smith and
Robert McCunn their executors or administrators shall and will at all times and
from time to time during the continuance of these presents be true and faithful unto
the said George Paterson his heirs and aʃsigns in and about the vending and disposing
of the said sugar respectively which shall be annually made on the said plantations
or estates of Union and Marli respectively and shipped sent consigned supplied
and delivered to them the said James Smith Archibald Smith and Robert McCunn
their executors administrators or aʃsigns in all things and act therein to the best of their
ability knowledge and judgment and also be true and faithful in and concerning
all recipts payments reckoning accounts matters and things whatsoever by them
made had entered into _____ settled or done relative to the premises aforesaid or
any of them and shall and will on the thirty first day of March in every year account
with and after deducting the said annual sums of Two thousand five hundred pounds
in and towards payment of the said sum of one thousand eight hundred pounds and
in and towards payment or reduction of the said sum of Sixteen thousand five hun
fred and fifty three pounds eight shillings and eight pence together with the interest
as aforesaid on the said sums of one thousand eight hundred pound and Sixteen thou

aʃsigns all sums of money balance or balances which shall have been received by or
come to the hands of the said James Smith Archibald Smith and Robert McCunn
their executors administrators or aʃsigns by all and every or any such sale or disposition
of the same sugars respectively And they the said James Smith Archibald Smith
and Robert McCunn for themselves their heirs executors and administrators do hereby
covenant promise and agree with and to the said George Paterson his heirs and aʃsigns

Administrators or aʃsigns shall and will yearly and every year and from
time to time during the continuance of these presents consign supply and deliver or cause
to be consigned supplied and delivered unto the said George Paterson his heirs or aʃsigns
with as little delay as may be so much and such quantities or sorts of stores supplies goods
wares and merchandize as the said George Paterson his heirs or aʃsigns shall required for the
consumption or use of the said estate of Union or Marli and also shall and will from time
to time well and truly accept and pay all bills of exchange or orders in writing reasonable
in amount which may be by the said George Paterson his heirs or aʃsigns drawn or given for
or on account of or relating to the same estates or either of them Provided always and
it is hereby agreed and declared by and between the said George Paterson and the said
James Smith Archibald Smith and Robert McCunn that it shall and may be lawful?
for the said George Paterson his heirs executors administrators or aʃsigns to increase the said
stipulated annual payment or sum of Two thousand five hundred pounds to such lur
ger sum or sums as he from year to year shall find it convenient to pay and to pay
off and discharge the whole of the said several sums of one thousand eight hundred pounds

at any time giving to them the said James Smith Archibald and Robert McCunn
six months notice f such intention to pay off the _____ at their Compting House in
Glasgow and that upon full payment of the said several before mentioned sums of money
and all interest thereon and of all and every such further sum and sums as they the said
James Smith Archibald Smith and Robert McCunn may at any time hereafter
advance or pay to or for the said George Paterson his heirs executors administrators or aʃ
signs or on account of the said Estates of Marli and Union or either of them that they
the said James Smith Archibald Smith and Robert McCunn their executors adminis
trators or aʃsigns shall and will at the request costs and charges of the said George Paterson
his executors administrators or aʃsigns surrender yield up and deliver unto him the said
George Paterson his heirs executors administrators or aʃsigns the said estate or plantation
called Marli lands slaves hereditaments and premises hereby aʃsigned or intended
so to be freed and discharged of and from the said term of one thousand years created and
granted in and by the said Indenture of the twenty third and twenty fourth days of
March one thousand eight hundred and twenty four together with the said Indenture
and these presents and freed and discharged of and from the said several sums of one
thousand eight hundred pounds and Sixteen thousand five hundred and fifty three
pounds eight shillings and eight pence and all interest thereon and all and every claim
and demand whatsoever under and by virtue of the said recited Indentures and of these
presents In witneʃs whereof the said parties to these presents have hereunder severally
and respectively subscribed and set their hands and seals the day and year first before

Before His Honor John Sanderson Chief JusticePersonally came and appeared James Macadam of the town of Saint George
of the Supreme Court of Judicature held in and for
the said Island of Grenada and its dependencies established
in the said Island of Grenada Gentleman who being duly sworn upon the Holy
Evangelists of Almighty God maketh oath and saith that he was present and did
see George Paterson for himself and as and for his own free and voluntary act and
deed and also Robert Kirk as the attorney in the several and respective names
of and as and for the several and respective free and voluntary acts and deeds of
John Ryburn, Andrew Ranken, James Smith Archibald Smith and Robert
McCunn the parties executing the within or aforegoing Indenture sign seal
execute and deliver the same and that the names or signature “Geo. Paterson”
“John Ryburn by his attorney Robert Kirk” “Andrew Ranken by attorney
Robert Kirk” “James Smith by his attorney Robert Kirk” “Archibald Smith
by his attorney Robert Kirk” and “Robert McCunn by his attorney Robert Kirk”
