Part 310s – Smith Robertson Genealogy – Indenture Research – 1830 James Smith & Jeanne Boyle Again

Morning,

The skies cleared up in Tampa Bay a wee bit last night for the candle-rockets, sparklers, and sonic booms. The quadrupeds did not enjoy their evening walks.

Did you know that today, July 5th is the Independence Day in Algeria? The year it happened was 1962. Independence was from France. Believe it or not, Algeria had been taken by the French in 1830. At about that point in time there were some Brunhammers who did migrate from Alsace to Algeria. Coincidentally 1830 seems to be the same year that I have been of late focused on in my Indenture Research Project in the search for the genealogy of my ggg-grandfather James Smith.

And in the US, some people may be somewhat a bit confused this July 5th. This year July 5th is considered the National Holiday as July 4th fell on a Sunday. The confusion is – July 5th in the US is also known as Workaholics Day. What’s a body to do?

This next Record from the Grenada Registers of Records as I mentioned in my previous Posting, Part 309s may have been between ggg-grandfather James Smith and one Jeanne Boyle. This Record is a further elaboration of the details of the previous part and was made 2 November 1830.

There does not appear to be any mention or intimation of the ancestral origins of ggg-grandfather James. There is one curious notation about a “Key of the Gate”. On Page 200 of the Indenture the wording indicates “the approbation and consent of the said James Smith who also reserves to himself the Key of the Gate of the said entrance or passage…” I wonder what that was about.

This Indenture made the second day of November in the year of our Lord
one thousand eight hundred and thirty Between James Smith of the Island
of Grenada of the one part and Jeanne Boyle of the said Island of the other
part Witnesseth that for and in consideration of the sum of Eight hundred
pounds current money of the Island of Grenada to the said James Smith in
hand well and truly paid at or before the sealing and delivery of these presents
the receipt of which said sum of Eight hundred pounds he the said James Smith
doth hereby acknowledge and thereof and therefrom and of and from every part and
parcel thereof doth acquit release and exonerate and discharge the said Jeanne
Boyle her heirs executors and administrators and the said James Smith hath granted

Bargained sold aliened released conveyed and confirmed and by
these presents doth grant bargain sell alien release convey and confirm
unto the said Jeanne Boyle in her actual poʃseʃsion now being by virtue
of a bargain and sale to her thereof made for one whole year in consideration
of five shillings by Indenture bearing date the day next before the day of the
date of these presents and by force of the statute made for transferring of
uses into poʃseʃsion and to her heirs and aʃsigns All that lot piece or
parcel of land situate lying and being in Young Street in the Carenage
in the town of Saint George in the Island of Grenada aforesaid with the house
or houses buildings and erections thereon erected built standing or being
containing Eighteen feet in front and Eighty seven feet in depth abutted and
bounded as follows that is to say South West by Young Street aforesaid
Northwest by lands of the said James Smith and South East by lands
of McSween or howsoever otherwise the same is abutted and bounded
distinguished led known or described and also to all meʃsuages tenements rights
members privileges profits commodities emoluments advantages heredita
ments and appurtenance whatsoever to the said lot piece or parcel of land
meʃsuages tenements buildings and premises thereon or to either or any of
them or any part thereof belonging or in any wise appertaining or therewith
or with any part or parcel thereof now most commonly or usually held let
occupied used poʃseʃsed or enjoyed accepted reputed deemed taken or known
as part parcel member thereof or any part thereof and the reversion and
reversions remainder and remainders rents issues and profits of all and
singular the said premises and every part and parcel thereof with the
appurtenances and in addition to the said premises the aforesaid James
Smith by these presents grants unto the said Jeanne Boyle a free right of
entrance or paʃsage on the northwest side of the above described premises
during the hours from sunrise in the morning till the hour of nine
o’clock at night extending from the street Thirty five feet in length and
Tree and one half feet in breadth and no more the said James Smith re
serving into himself his heirs executors and aʃsigns a similar right to
the said entrance or passage which is neither to be widened or retrend or
otherwise altered many way without the approbation and consent of the
said James Smith who also reserves to himself the Key of the Gate of the
said entrance or passage and also all the estate right title interest property
claim and demand whatsoever in Law or equity of him the said James Smith
of in and to all and singular the said premises above mentioned and of in
and to every part and parcel thereof with the appurtenances and also all
deeds evidence and writings touching or concerning the said premises only or
any part thereof together with true copies of all other deeds evidence and writings
which do concern the said premises or any part thereof jointly with any other
lands or tenements now in the custody or poʃseʃsion of he the said James Smith

same copies to be made taken and written at the proper costs and charges of
the said Jeanne Boyle her heirs and aʃsigns To have and To hold all and
singular the said piece or parcel of land hereditaments and premises above in
and by these presents released and confirmed and every part and parcel
thereof with the appurtenances unto the said Jeanne Boyle her heirs and
aʃsigns to the only proper use and behoof of the said Jeanne Boyle her heirs and
aʃsigns for ever and to and for no other use interest or purpose whatsoever and
the said James Smith his heirs executors and administrators doth covenant
promise and grant to and with the said Jeanne Boyle her heirs and aʃsigns
that he the said James Smith is the true and lawfull owner of all and singular
the said piece or parcel of land hereditaments and premises above mentioned
and of every part and parcel thereof with the appurtenances and all that he
the said James Smith at the time of the sealing and delivery of these presents
is lawfully and rightfully seized in his own right of a good sure perfect absolute
and of indefeasible estate of inheritance in fee simple without any manner of
condition mortgage limitation of use or uses or other matter cause or thing whatso
ever to alter change charge or determine the same and also that he the said
James Smith hath in himself at the time of the sealing and delivery of these
presents good and lawful power and authority to grant bargain sell and release
with the appurtenances the said premises unto the said Jeanne Boyle her
heirs and aʃsigns to the only proper use and behoof of the said Jeanne Boyle
her heirs and aʃsigns for ever according to the true intent and meaning of these
presents and also that her the said Jeanne Boyle her heirs and aʃsigns shall
and may at all times for ever hereafter and quietly have hold occupy
poʃseʃs and enjoy all and singular the said piece or parcel of land hereditaments
and premises aforesaid with the appurtenance and every part and parcel thereof
without the lawful let suit trouble hindrance molestation interruption eviction
or disturbance of him the said James Smith his heirs and aʃsigns of any other
person or persons lawfully claiming or to claim by from or under him and that
free and discharged or otherwise well and sufficiently saved kept harmeʃs and
indemnified of from and against all former and other gifts grants leases mortgages
jointures dowers wills intails uses bonds annuities writings obligations recogni
zances judgments execution rents and arrearages of rent and of and from all
other charges intents rights titles troubles and incumbrances whatsoever had
made committed doe or suffered by him the said James Smith his heirs or any
person or persons lawfully claiming or claim by from or under him and lastly that
he the said James Smith and his heirs and all and every other person and
persons and his heirs lawfully claiming any estate right title or interest
of in and to the said premises above in and any these presents released and con
firmed or any part thereof by from or under him shall and will from time to
time and at all times hereafter upon the reasonable request and at the proper costs

And charges in the law of her the said Jeanne Boyle her heirs and
aʃsigns make do sign seal and execute or cause and procure to be made done
signed and executed all and every such further and lawful and
reasonable act and acts thing and things device and devices conveyance and
conveyances aʃsurance and aʃsurances in the law whatsoever for the further better
and more perfect granting conveying releasing confirming and assuring of
all and singular the said premises with the appurtenances and every part
and parcel therof unto the said Jeanne Boyle her heirs and aʃsings to
the only proper use and behoof of the said Jeanne Boyle her heirs and
aʃsigns for ever as aforesaid as by the said Jeanne Boyle her heirs and
aʃsigns or her or their counsel learned in the law shall be reasonably ad
vised and required In witneʃs whereof the said party to these presents
has hereunto set his hand and seal the day and year first above written
