Part 268s – Smith Robertson Genealogy – Indenture Research – 1829 James Smith - Property

Morning,

The Transcription Project is continuing, and continuing, and continuing… and I swear the “legalese” just seems so much like added words written in as filler, but then again I’m not a lawyer. But I’m certainly learning quick and easy short-cuts on how to copy and paste in Word, the continued repetitions of phrases.

This next Record, I believe is another “Peppercorn Transaction”. James Smith, the Carpenter, and possibly ggg-grandfather James Smith purchases another lot and parcel of land in what appears to be on the waterfront of the Carenage in the Town of Saint George, Grenada. And again there does not seem to be any reference to ggg-grandfather James’ genealogy and ancestry.

This Indenture made the thirtieth day of March in the
year of our Lord one thousand eight hundred and twenty nine Be
-tween James Bain of the Town of Saint George in the Island of
Grenada Esquire of the one part and James Smith of the said
Town and Island Carpenter of the other part Witnesseth that
the said James Bain for and in consideration of the sum of Five
shillings of current money of the said Island to him in hand well
and truly paid by the said James Smith set or before the sealing
and delivery of these presents the receipt whereof is hereby acknow
ledged Hath granted bargained and sold and by these presents
Doth grant bargain and sell unto the said James Smith his execu
tors administrators and aʃsigns All that lot piece or parcel of land
situate and being in Scott Street in the said Town of Saint George
and extending from thence to the boundary line of the Harbour of
the Carenage containing Pne hundred and one feet in front and
Two hundred and fifty five feet in depth or thereabout bounded on
the North by lands of Bernard Hannah On the South be lands of
James Niccol and William Hood On the West by Scott Street afore
said and on the East by the Boundary line of the Harbour of the
Carenage or howsoever otherwise the same is abutted bounded Known
distinguished or described together with the capital meʃsuages or te
nement thereon and also all other tenements edifices erections and
buildings thereon erected and built standing or being and also all
ways paths paʃsages lights easements waters watercourses drained
walls fences privileges commodities and advantages whatsoever
to the said lot piece or parcel of land buildings and premises be
longing or in any wise appertaining or therewith or with any part
thereof commonly held used occupied or enjoyed or accepted reputed
deemed taken or known as part parcel or member thereof and
the reversion and reversions remainder and remainders rents
iʃsues and profits of the said premises To have and To hold the
said lot piece or parcel of land Capital meʃsuages buildings and pre
mmises hereby bargained and sold or intended so to be with their
and every of their rights members and appurtenances unto thesaid
James Smith his executors administrators and aʃsigns from the
day next before the day of the date hereof for and during and until

The full end and term of one whole year thence next ensuing
and fully to be complete and ended Yielding and Paying thereto?
at the capixation? of the said term the rent of one pepper corn if
the same shall be lawfully demanded To the intent and purpose
that he the said James Smith may be in the actual possession
of all and singular the said premises hereby bargained and sold
or intended so to be with their appurtenances and thereby be enabled
to take and accept of a grant and release of the freehold reversion and
inheritance thereof to him the said James Smith and his heirs
in and by an? Indenture of Release intended to bear date the day
next after the date of these presents and to be made between the
said James Bain and Margaret his wife of the one part and the
