Part 292s – Smith Robertson Genealogy – Indenture Research – 1829 James Smith, The Carpenter

Afternoon,

As mentioned in my preceding Post, the Transcription Project continues. This is my search for the genealogy, ancestry, and family tree of my ggg-grandfather James Smith.

This next Record dated 21 October 1829 and examined and entered to the Grenada Registers of Records 29 December 1829 reflects a property business transaction of one James Smith of the Island of Grenada and identified as a Carpenter. All-things-being-equal this may be ggg-grandfather James. The other mentioned executors of the transaction are the couple James and Margaret Bain, who, at this time seem to be now resident in Bristol, in England.

This Record is noted and titled with the letter B. Cross-referencing my previous work and matching the concerned parties as well as the identified lot and parcel of land, it appears that this Document may be an addendum to the Record that I transcribed in Part 269s.

Unless I am missing something there does not appear to be any additional clues to the ancestry and origins of this James Smith.

This Indenture made the twenty first day of October in the
year of our Lord one thousand eight hundred and twenty nine Between
James Bain of the Island of Grenada Esquire and Margaret his
wife of the one part and James Smith of the said Island Carpenter
of the other part Whereas by an Indenture of release bearing date the
thirty first day of March in the year one thousand eight hundred and
twenty nine and grounded on a Lease for a year bearing date the day next
before the day of the date of the said Indenture of Release and the release
being made or expressed to be made between the said James Bain and
Margaret his wife of the one part and the said James Smith of the other
part It was witneʃsed that for the considerations therein mentioned
They the said James Bain and Margaret his wife Did grant bargain sell
release and confirm unto the said James Smith and his heirs A certain lot?

Piece or parcel of land situate and being in Scott Street in the town of
Saint George in the Island of Grenada aforesaid together with the capital
messuage and all other houses outhouses edifices erections and buildings
thereon and in the said Indenture now in recital and hereinafter more
particularly mentioned and described To hold the same with their and
every of their rights members and appurtenances unto the said James
Smith and his heirs To the only proper use and behoof of the said James
Smith his heirs and aʃsigns forever And whereas the said herein before in
part recited Indentures of Lease and Release have been duly executed by the
said James Bain but have not been executed by the said Margaret Bain
And the said James Bain and Margaret his wife have consented and agreed
to execute these presents to the intent that the said lot piece or parcel of land
buildings hereditaments and premises may be released and discharges from
all dower or thirds and right and title of dower or thirds of her the said
Margaret Bain of into or out of the same Now this Indenture witnesseth
that in performance of the said agreement and in pursuance of the covenants
for the first her aʃsurance contained in the hereinbefore recited Indenture of
Release and in order that the fee simple and inheritance of and in the said
lot piece or parcel of land buildings hereditaments and premises may be
more effectually released and aʃsured unto and to the use of the said James
Smith and his heirs freed and discharged of and from all dower and right
and title to dower of her the said Margaret Bain and in consideration of
the sum of ten shillings of lawful money of Great Britain to the said James
Bain and Margaret his wife in hand well and truly paid by the said James
Smith at or before the sealing and delivery of these presents the receipt of
which said sum they do hereby acknowledge They the said James Bain and
Margaret his wife Have and each of them Hath granted bargained sold
remised released and forever quit claimed And by these presents Do and
each of them Doth grant bargain sell remise release and forever quit claim
unto the said James Smith and his heirs All that lot piece or parcel of land
situate and being in Scott Street in the town of Saint George in the Island of
Grenada aforesaid and extending from Scott Street aforesaid to the boundary line
of the Harbour of the Carenage containing one hundred and one feet in front and
two hundred and fifty five feet in depth or thereabouts bounded on the north by land
of Bernard Hannah on the south by lands of James Nicol William Hood on
the West by Scott Street aforesaid and on the East by the boundary line of the
Harbour or howsoever otherwise the same is abutted bounded known distinguished
or described together with the capital meʃsuages or tenement and all other houses edi
fices erections and buildings thereon erected and built And also all ways paths
paʃsages waters watercourses drains lights easements privileges profits commodities
and advantages whatsoever to the said lot piece or parcel of Land buildings and prem
ises belonging or in any wife appertaining or which to and with the same now are or

appeared the with named James Bain and Margaret his wife who sever
ally acknowledged that they did sign seal and as and for their respective act
and deed execute and deliver the within Indenture and the said Margaret
Bain being examined by me privately and apart from her said husband
did acknowledge confess and declare that she so execute the said Indenture
of her own free will and accord and without any fear threats or compulsion of
or by her said husband used and having explained the contents of the said deed
she declared that she was well acquainted with and perfectly understood the same

named James Bain of the Island of Grenada in the West Indies Esquire
now resident in the said City of Bristol and Margaret his wife which said _____

proper handwriting of this deponent and the said John Bailey whose the same

Britain and Ireland called England Do hereby certify that on the day of the
date hereof Personally came and appeared before me James Bain of the Island
of Grenada in the West Indies Esquire but now resident in the said City of
Bristol and Margaret his wife parties to the Indenture or Deed hereunto an
nexed and did then severally acknowledge before me the same Indenture or
Deed to be their and each of their free and voluntary several and respective act
and deed and acts and deeds And that they severally signed sealed delivered
and executed the same Indenture or Deed for the uses and purposes therein
mentioned And the said Margaret the said wife of the said James Bain
being examined by me privately solely and separately apart and distinct from
the said James Bain her said husband acknowledge confessed and declared
that she made and executed the said Indenture or Deed of her own free will and
record and without any fear threat compulsion force or coercion of or by the said
James Bain her said husband or any other person or persons whomsoever And
that at the time of the execution thereof she knew the same to be a Lease of her
dower of and in the lot piece or parcel of land and the capital meʃsuage outhouses
edifices erections buildings and premises therein mentioned and described And
I the said Mayor do hereby also certify that on the day of the date hereof also personally
came and appeared before me John Cornish of the said City of Bristol Gentleman
the deponent named in the Affidavit hereunto annexed who is a person well
known and worthy of good credit and by solemn oath which the ^said deponent then
took before me upon the Holy Evangelists of Almighty God dis so solemnly and
sincerely declare testify and depose to be true the several matters and things men
tioned and contained in the said annexed Affidavit

Now on to the next. At some point in time, and in some document I hope to find that clue or that hint to the ancestry and origins of ggg-grandfather James Smith.
