Part 210s – Smith Robertson Genealogy – Indenture Research – 1816 Three Smiths

Happy International Pancake Day! Guess what’s for supper? Nope. Tilapia, black beans, yellow rice and plantain…

As I mentioned I don’t stop. I’ve reordered the microfilm FHL [1563328] so that I can get the missing page for the LWT of Benjamin D’Harriette Smith from Item 10. I’ll also be able to double check to see if I may have missed something, especially in Item 9. It’s the only Item from which I do not have any Smith-related Records.

This afternoon’s Record is a three page document; pages 22, 23, and 24 from Item 11 of the same Grenada Register of Records, 1797-1817 (v. Gr-R2). I’m not sure exactly what type of document it is but it does include three Smiths: Archibald, James, and James Junior. The document appears to be a sort of Power of Attorney which is seems to be replacing any previous ones created on their behalf.

Previous references to these gentlemen, specifically Archibald, James, and James Junior are included in Part 192s and Part 207s. In my search and research it appears that according to the work that I have found online Archibald Smith is the father in one article and the younger brother of James Smith, in another. Also there may have been an elder brother, one William Smith, as well as a brother James Smith. It does get confusing, in a following Posting I attempt to graphically depict that which I think I have found.

From what I can deduce the James Smith Junior of the three above-mentioned Documents may have been ggg-grandfather James Smith, but he definitely could not have been my gg-grandfather James Smith Junior. My gg-grandfather James Smith Junior was born in the year 1815.

To all to whom these present shall come Archibald Smith of Jordan Hill, Adam Crooks,
John Guthrie, John Ryburn, James Smith, Andrew Rankin, and James
Smith Junior all of the City of Glasgow, in that part of Great Britain called Scotland,
Merchants Copartners carrying on trade there under the firm and designations of H.
Leitch and Smith and also as Copartners along with John Lindsay of the Island of Grenada
carrying on trade in that Island under the said Copartners have resolved to Nominate and appoint
some persons as their Attorneys to act in the Said Island of Grenada and in all the other
British and Foreign West India Islands and Colonies except the Island of Jamaica for the
purpose of managing all and every of their mercantile Affairs and busineʃs as also H.
Collection and receiving debts selling and Conveying ships carrying or suits at law or in equity
leasing and selling Heritages & Messuages and doing and performing the several matters
and things herein after mentioned. Now therefore Know all? that the said Archibald
Smith, Adam Crook, John Guthrie, John Ryburn, James Smith, Andrew Rankin
and James Smith Junior Copartners foresaid Have made ordained Nominated
Constituted and appointed and by these presents do make ordain Nominate Constitute
and Appoint the said John Lindsay of the said Island of Grenada Esquire Merchant
and William Kirkland late of Carriacou in the Government of Grenada Esquire Merchant
presently in Great Britain Jointly and each or either of them separately whom both failing by death
or absence from the said Island of Grenada or resignation or refusal to accept, then William
Mitchell of the said Island of Grenada Esquire Planter and Robert Kirk of the same Island
Esquire Merchant jointly and each or either of them separately to be the true certain and
lawful Attorney’s and Attorney of the said Archibald Smith, Adam Crooks, John Guthrie
John Ryburn, James Smith, Andrew Rankin, and James Smith Junior, Copartners
foresaid In the places foresaid For them the said copartner and in their names and
in the names of the Survivors or Survivor of them as Copartners foresaid, or in the name
of the said House or Houses of Trade To Manage Negociate and transact the whole affair
and busineʃs of the said Archibald Smith, Adam Crooks, John Guthrie, John Ryburn
James Smith, Andrew Rankin and James Smith Junior as Copartners foresaid of the
said House of Trade and Copartnership of Leitch and Smith and Guthrie and Ryburn
In the whole places foresaid as fully freely and Effectually in every respect and to all
intents and purposes as the said Archibald Smith, Adam Crooks, John Guthrie, John
Ryburn James Smith Andrew Rankin and James Smith Junior or any of them can
do if personally present and particularly without prejudice to or limitation of the
sais General powers to ask demand for recover and receive all debts and sums of
Money which now are or hereafter may become due and payable to these or any of them
either by Mortgage, Bond, Bill Promiʃsory note, open account, account stated and
Balanced or otherwise whatsoever from all and every person or persons in any of the
said places by whom the same is or hereafter may become due and unpaid and if
needful to Call to Account bring to a Reckoning and adjust and settle all and every
demand whatsoever with all and every person or persons concerned in the premises, And if
upon Receipt and Recovery of the said debts and sums of Money due and to become due
us aforesaid or any part thereof sufficient aʃsignations, Conveyances acquittances and discharges
to make and Give foe the same and upon non payment thereof or any part thereof all and every
person and persons so addebted To sue arrest attach implead Imprison and prosecute for the
same by legal ways and means And upon payment thereof or any part thereof the same
persons again to Acquit and discharge and out or prison to Release and in like manner for them
the said Archibald Smith, Adam Crooks, John Guthrie, John Ryburn, James Smith, Andrew
Rankin and James Smith Junior and each of them and in their and each of their
names as Copartners foresaid or for and in name of the said Companies of Leitch and
Smith and Guthrie and Ryburn to raise and Prosecute all actions or Suits at Law
or in Equity and to appear for them in all such Actions or Suits which may be raised against
them and to enter Satisfaction or Judgments in law or in equity and in like manner for

purpose of binding and obliging them and each of them to abide by and perform the Award or order of
any Arbitrator or Arbitrator umpire or umpires to be nominated and Chosen to act and determine
in relation to the premises And father for them the said Archibald Smith, Adam Crooks, John
Guthrie, John Ryburn, James Smith, Andrew Rankin, and James Smith Junior or for or in
the name of the said Copartnerships of Leitch and Smith and Guthrie & Ryburn to treat with any
person or persons whatever for the Leasing selling or either Disposition of all or any of the
meʃsuages Houses Ground slaves and Hereditaments in the said Island of Grenada or in any
of the Islands or Colonies aforesaid or any of them belonging or which may hereafter belong to the
said Archibald Smith, Adam Crooks, John Guthrie, John Ryburn, James Smith, Andrew
Rankin and James Smith Junior or any or either of them as Copartners foresaid or to the said
Leitch and Smith and Guthrie and Ryburn and after any treaty and agreement made and
aʃsignment Conveyance or Aʃsurance to any person or persons that shall purchase and Lease or
Agree to purchase and Lease the premises or any of them or any part of them as the said attorneys
or Attorney shall think fit for the sufficient aʃsigning conveying and aʃsuring of the same
Meʃsuages Houses grounds Hereditaments and Slaves which shall be so purchased Leased
and sold as aforesaid to the person or persons who shall contract for and buy the same or
any of them for the Execution of every such treaty and agreement as aforesaid And generally
fo them the said Archibald Smith, Adam Crooks, John Guthrie, John Ryburn, James Smith
Andrew Rankin, and James Smith Junior in their names or in name of the said
Companies of Leitch and Smith and Guthrie & Ryburn and their and each and every of their
acts and deeds to make do sign seal execute deliver, Transact accomplish and perform all
and every matter and thing neceʃsary and Requisite in or about the premises in as full ample?
and beneficial a manner as they and every of them might or could do if personally present
And with power to the Said John Lindsay and Attorney or Attornies to act either under or
along with them or any or either of them the said John Lindsay and William Kirkland
whom failing as aforesaid William Mitchell and Robert Kirk to Nominate Constitute
and Appoint in the foresaid Islands and Colonies or any of them for the purposes and with all
and every the powers hereby to them given or such part thereof as the said John Lindsay shall
think proper, and the same at pleasure to revoke annul and make void Ratifying and
Confirming as they the said Archibald Smith, Adam Crooks, John Guthrie, John Ryburn
James Smith, Andrew Rankin and James Smith Junior for themselves as Copartners
aforesaid and to the said companies do by these presents Ratify Confirm & Declare valid
and effectual all and Whatsoever the said Attorneys or Attorney or the substitutes or
Substitute under or with them or any of them to be appointed as aforesaid shall lawfully
do or Cause to be done by virtue hereof in relation hereto and Lastly the said
Archibald Smith, Adam Crooks, John Guthrie, John Ryburn, James Smith, Andrew
Rankin and James Smith Junior, do by these presents revoke and Annul all Letters of
Attorney formerly Granted for them or their or any of their Attorneys or Attorney to any persons
or person for managing their affairs and busineʃs as Copartners aforesaid or the affairs and
busineʃs of the said Houses of trade of Leitch and Smith and Guthrie & Ryburn in all or
any of the Islands or Colonies aforesaid. In witneʃs whereof they have hereunto set

faith? is and right to be given and by solemn oath which he then took before me upon
the Holy Evangelists of Almighty God did testify and depose to be true the several
matters and things therein contained.
